April 11 2017 THE NOOSE TIGHTENS WILL DANIEL EVER GO HOME? We all respond: Of Course! Well everyone that is except the Government’s Prosecutor. He insisted the Judge sentence Daniel to 28 years or more. She didn’t grant his wish. But is the prosecutor done with his plea "to sentence this felon so he can’t endanger anymore people selling his bleach?" Answering Daniel’s current motion to be released while his appeal is snail waltzing through the Appellate Court, the Prosecutor wrote to the Justices of the 9th Circuit Court of Appeals: "Smith does not express remorse for his conduct or sympathy for his victims, and he does not attempt to refute the evidence in the record concerning the harm suffered by the victims of his crime. That evidence confirms the risk to the community if he were to be released and continue to advocate the use of Sodium Chlorite as a treatment for illness." Some of this Justice Department prosecutor’s argument is an absolute lie. I was present for Daniel’s trial and the Prosecution NEVER presented one victim who had used MMS. Not one! There is "no evidence in the record," as he claims herein. Thus this paragraph is a lie. Worse is the sad reality that the deception and conniving barage is coming from the mouth of the Justice System itself. Justice in America has become almost a joke...but I’m not laughing! Consider 7 states now have debtor prisons. (Banned for almost 200 years before being reborn now.) Are you aware that the USA has only about 4.6% of the world’s population and yet shockingly almost 23% of the world’s imprisoned people? Pushing 7,000,000 jailed or on parole today or about 1 out of every 35 people. So - I repeat, Will Daniel Ever Go Home? Tragically a frightening conundrum isn’t it? NEWS FROM THE APPEAL’S COURT: The 9th Circuit Federal Court of Appeals is deciding on two matters: (1) Releasing Daniel on bail now pending a decision on his appeal. and (2) Deciding on his Appeal itself. Please pray that the Appellate Judges will release Daniel right away - while they dillydally with their ruling on the appeal. Speaking about the Appeal the 9th Circuit has extended the time for the Prosecution to file their opposition to Daniel’s appeal. It’s not due until May 1, 2017. So when might Daniel’s appeal be known and what will it accomplish? The Appellate Court can decide to speedily approve or deny the appeal; or they can sit on their hands for as long as they want. Their eventual response may result in any one of a variety of outcomes: viz., Overturn the Conviction; Deny the Appeal; Order a New Trial; etc. Today, April 11, 2017, Daniel has been wrongly jailed for 684 days. BACK AT SEATAC FEDERAL DETENTION CENTER: Last month Daniel was very sick for over a week. He’s better now. But just since the first of the year Daniel has lost about 35 pounds. Prison food is not famous for being nutricious or healthy. Daniel’s free time is mostly spent reading from the collection of books you have sent him. He can talk on the pay phone very briefly to his wife and daughter but is only allowed 30 minutes a month. He uses the prison computer but can not go on the internet, receive attachments or spend much time as hundreds of other inmates want their turn as well. Did you know that Daniel is an accomplished muscian and has won singing contests? Several years back he placed 2nd in a national contest for writing the best new song of the year. His stage name is Daniel Votino. Daniel’s first love has always been music.
