NEWS FROM THE APPEAL’S COURT: The 9th Circuit Federal Court of Appeals finally dropped their two legal road blocks and permitted Daniel’s attorney to file the huge appeal (hundreds of pages). He filed it on Feb. 14, 2017. The Court ordered the Prosecutor (Government) to file their answer to Daniel’s appeal by March 14, 2017. BUT the Prosecutor begged for more time and the Court granted them until May 1st. Once the Government files against Daniel’s Appeal on May 1, 2017 then Daniel’s Attorney has until May 15 for any response. So, focusing ahead to mid-May, the $64,000 Question is Will the appeal be decided shortly after May 15th? YES OR NO? Well ~ the Appellate Court can decide to speedily approve or deny the appeal; or they can sit on their hands for as long as they want. Please pray for the former. Their eventual response may result in any one of a variety of outcomes: viz., Overturn the Conviction; Deny the Appeal; Order a New Trial; etc. Today, March 11, 2017, Daniel has been wrongly jailed for 654 days. BACK AT SEATAC FEDERAL DETENTION CENTER: Daniel has been deliriously feverish for more than a week...mostly stayed in bed. One person wrote asking: "How he can be so sick ~ isn’t he taking his MMS?" Inmates can NOT take MMS or any non-approved item. The Bureau of Prisons strictly enforces this prohibition. Now that he is well Daniel continues to work as a chaufer for other inmates or whomever the Prison assigns him. He gets to transport the person to verious places such as medical appointments, to the Train or Bus Depot, Airport, etc. He is one of only 2 such inmates allowed to do this. What an honor! He is able to taste freedom each trip until he returns to SeaTac Prison. Sadness of a jailed lonely man who pleads "Please don't forget me, because the possibility of that hurts more than being in this prison." DANIEL WROTE YOU A NOTE: "Dear Friends and Family This is Daniel Smith. I’m writing from federal prison where I will have been now for two years this coming May. I wanted to write to express my gratitude for all your continued support along this journey, without which I may have given in to much despair. This time has been exceedingly good for me, and I am eternally grateful to have had so many friends along the way; all your postcards, letters, books, photos, encouraging words... continue to bring me smiles, hope, and the reminder that I am not alone. Thank you! Thank you also for your continued support of my family, especially Karis and Sabby. Your prayers and financial help have continued to bless and give them more hope than you can imagine. Sabby is now 12 years old and more than half her life has been over-shadowed by our struggle with the federal government. We are looking forward to a Grand Reprieve. Speaking of Reprieve, if you haven’t already, please consider signing and sharing the petition to President Donald J. Trump to stay my sentence pending the outcome of my appeal. Mr. Trump has the authority to do so under the U.S. Constitution and this would return me home to my family while we await the appeals process. However, we are informed that without either the facts or the law on their side, the Ninth Circuit will likely reverse. The appeal makes clear, for example, there was never even probable cause for an indictment to begin with, having failed to allege the essential elements necessary to comprise a single crime. It could take many months, however - possibly the remainder of this year - just for the Court to return its opinion. Until then and after, I am exceedingly grateful for all your continued support.
