Daniel Smith | February Update

MOVEMENT: ALBEIT SLOW ~ Last Update in January two road blocks prevented Daniel’s appeal from going forward: The Appeal was on hold because (1) the Appelate court had refused to respond to a simple request by Daniel’s Attorney; and (2) instead granted the Prosecution an-unlimited-extension-of time to respond to Daniel’s Appeal.



Today, Feb. 8, 2017, Daniel has been wrongly jailed for 623 days.

Finally with turtle-like speed the Appelate court (1) has answered Daniel’s attorney’s simple request and has now allowed him to file the enlarged Appeal Brief on or before March 6, 2017.
Note: Daniel’s Attorney can...and likely will...file it in February...trying to expedite the turtle pace.

Once the Appeal Brief is filed, then the Government has 30 days to file their Answer to Daniel’s Brief. In other words - the Prosecutor must file his argument against Daniel’s appeal brief on or before April 6, 2017.
Note: If Daniel’s brief was filed early...then the Government’s 30 day response time is moved up accordingly.

Whatever the date turns out to be that the Government posts their argument against Daniel - then Daniel’s attorney has 14 additional days to rebut the Government’s argument.

Then the Appellate Court can decide to speedily approve or deny the appeal; or they can sit on their hands for as long as they want. Please pray for the former. Their eventual response may result in any one of a variety of outcomes: viz., Overturn the Conviction; Deny the Appeal; Order a New Trial; etc. Not being an attorney and having seen more twists and turns than the Indianapolis 500 nothing would surprise me as this process continues. But, for you readers, I am simply trying to make some semblance of order out of this helter-skelter-like injustice.

BACK AT SEATAC Federal Detention Center, Some GOOD NEWS. Daniel’s good behavior has earned him some perks: A 14-hour furlough spent with Karis in the greater Seattle area; a new position as a chaufer for other inmates or whomever the Prison assigns him. He gets to transport the person to verious places such as the Train or Bus Depot, Airport, etc. He is one of only 2 such inmates allowed to do this. What an honor! He is able to taste freedom each trip until he returns to SeaTac Prison. I tribute these good events to the earnest petitions of you outstanding supporters. Thank you for your continuing support.

UPDATED: How to mail a book(s) to Daniel: Some of you have sent Daniel a book only to have it rejected by the Prison and returned to you. Here is an improved way to succeed: (1) It must be a paperback (no hardcovers) and (2) It is best if sent by Amazon or another large book store - - most importantly (3) use the exact shipping info below for the shipping information:
